Basic Leasing Rights

Also known as non-exclusive rights, purchasing a basic lease grants the customer (licensee) limited artistic and legislative rights to the corresponding beat(s) for one single profitable/commercial use on any medium (e.g. album, EP or mixtape) with a circulation of up to 2,000 sales units. If this point of sale is reached and further sales are desired, also further rights with a new sales cap need to be obtained. If the beat is no longer available for leasing (exclusive rights have been sold), no more sales can be made after the sales cap is reached. A basic lease comes as a mixed, untagged, high quality MP3 file, and a contract stating the rights of use. A beat can be leased to more than one person at the same time until exclusive rights to the beat are sold. Once a beat has been sold with exclusive rights, it will no longer be available for any kind of leasing, however, leasing rights to the beat that have already been obtained will remain valid until the sales cap has been reached or the term of the contract has ended. This license is valid for one (1) year from the execution of the agreement. The license will no longer be valid after one year of its purchase date, and must be renewed if the Licensee wishes to maintain these rights. The customer (licensee) is not allowed to get radio-, video-, or television-airplay, or to perform the song at commercial/profitable shows with a basic lease. The Licensee shall not edit the Instrumental in any way including but not limited to changing the arrangement, removing or altering melodies, instruments, drum and rhythm programming, or sounds that are contained within the Instrumental. The licensee understands that the licensor (seller) maintains 100% copyright and ownership of the original instrumental composition. Licensee (you) can not sell or license the rights to the Instrumental whether in whole or part to any other party. Licensee must give credit to the producer where possible in a written form. Exclusive Rights

Exclusive rights grants the customer full artistic and commercial rights to the beat. All rights included in leases are permitted with exclusive rights, but on an unlimited scale. You (customer) are given the right to unlimited sales and profitable shows, as well as radio-, video-, and television-airplay of your song created with the beat. An Exclusive Rights purchase comes as a mixed untagged WAV file, and separate unmixed stem files of the beat (tracked out). A contract for Exclusive Rights must be agreed upon and signed (virtually or physically) before it’s valid. Once a beat has been sold with exclusive rights, it will no longer be available for any kind of leasing/sale. The beat will be marked on the website as ‘sold’ and any possible download and/or licensing option will be removed. Exclusive rights pricing varies from beat to beat.

General Terms & Conditions

Term: All leasing agreements shall expire one (1) year from the execution of the agreement. The license will no longer be valid after one year of its purchase date, and will have to be renewed if the Licensee wishes to maintain these rights. If the Instrumental has been purchased exclusively, it will not be available for license renewal. Should the Instrumental be purchased exclusively during the term of the agreement, Licensee will still maintain all rights listed in the agreement, up to one year after license acquisition.

Payments: All payments are to be paid upfront and must be received before delivery of the product and/or service. Payments that are still pending and not credited yet must be credited before delivery. In the case of a refund by any of the parties, the issued contract becomes void. By making a payment, the customer declares that he is fully aware of all terms and conditions and agrees to them.

Delivery: Leases are delivered via an automatic system and will be delivered instantly after a successful payment transaction, however track-outs may require a separate delivery depending on the file size. In which case, the track-outs will be sent separately in a zip folder via email or a download link. No tangible copies of any product will be delivered, unless requested and agreed upon.

Samples: If a beat contains sampled material, the sample clearing of itself needs to be done by the customer, not by D-Rock Beatz. The customer (licensee) understands that they are responsible for clearing all samples that they choose to use and that the producer (licensor) cannot and will not be held liable for the misuse of any sampled material.

All terms and conditions are listed on the website drockbeatz.com. In case of a change in any of the listed points or should one point become invalid, all other points are still valid. Under no circumstances is the customer allowed to resell a beat, or rights to a beat, in any form. Rights that are given to a customer are not transferable.

Anybody abusing or disrespecting the listed terms and conditions will be prosecuted in the court of law to the fullest extent.
